		<description>I had to laugh...  How did the NLRB get to this outcome?  Can you post the Facebook post?  I would love to see how a post on Facebook was an attempt to organize, to bargain collectively through representatives of their own choosing, or otherwise to engage in other concerted activities for the purpose of collective bargaining or other mutual aid or protection?

Even the NLRB had stated on their web-site that

    What are protected concerted activities?

    The National Labor Relations Act (NLRA) protects employees’ rights to engage in protected concerted activities with or without a union, which are usually group activities (2 or more employees acting together) attempting to improve working conditions, such as wages and benefits. Some examples of such activities include:

    a) 2 or more employees addressing their employer about improving their working conditions and pay;

    b) 1 employee speaking to his/her employer on behalf of him/herself and one or more co-workers about improving workplace conditions;

    c) 2 or more employees discussing pay or other work-related issues with each other.

    The NLRA also protects any individual employee’s right to engage in union support, membership, and activities.

    The NLRA protects an individual employee’s right not to engage in union activities or in other protected, concerted activities. 

I will assume, trying to give points to the government, that the news media simply omitted that the Facebook post had something to do with &quot;self-organizing, forming, joining, or assisting labor organizations, bargaining collectively through representatives of their own choosing, and/or engaging in other concerted activities for the purpose of collective bargaining or other mutual aid or protection.  If not, I don&#039;t see how her post is protected by Section 7...

Now, you can simply go stand in Grand Central Station and yell anything(?) about your employer, and the NLRB thinks the employer can not fire you?

		<description>Badmouthing your employer in any non-internal forum is not good practice. Many people do it using leaks, news outlets etc. However, doing it publicly (which is what Facebook is) puts both parties in an awkward place. 

Should a person be disciplined for exercising their first amendment right? No, if it was done in a constructive manner after all other options were exhausted. However, the employee must be ready to face any disciplinary consequences or at least some sort of cold shoulder approach from the employer. I can’t believe any employee would think that the employer would come and hug him/her and say: Thank you, I never saw it that way before, please tell me more so I can improve the organization”. That never ever happens.</description>
